IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.

We reserve the right, in our sole discretion, to make changes or modifications to these Legal Terms at any time and for any reason. 1. OUR SERVICES

 

The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country. Accordingly, those persons who choose to access the Services from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.

 

2. ORDER AND DELIVERY

Confirmation Email: Upon successfully placing an order with Joi Gifts, you will receive a confirmation email. This email serves as an acknowledgment that we have received your order and are processing it accordingly. It will include essential details such as your order number, items ordered, and the total amount.

Order Status Updates: If you are logged into our site/app, you can track your order on the Orders page. Alternatively, you can use the "where is my order" link on the top of the home page.

Customer Cooperation: To ensure a successful delivery, customers are requested to provide accurate and complete delivery information, including a valid contact number for the recipient and a valid email address of the sender. 

Out-of-Stock Notification: In the rare event that an item you ordered is out of stock, we will promptly notify you via WhatsApp or phone. You will have the option to replace the item/s, choose an alternative, or receive a refund for the out-of-stock product.

Customization Requests: If your order includes personalized or customized items, our team will review your requests to ensure they align with our customization guidelines. We may reach out to you for additional details or clarifications if needed. Your prompt response can affect the delivery times. The order may be moved to the next time slot or day if there is no response from your side within our delivery cut-off times.

Delivery Date Confirmation: You may choose a delivery date and time slot while making the order. We are unable to commit to a specific delivery time, but we strive to deliver the order within the time slot selected. If any issues arise regarding the chosen date or timeslot, our customer care team will promptly reach out to you for a resolution.

Product Appearance: Occasionally, the received product may look slightly different from the website photo due to factors like lighting and material variations. However, any differences are minimal and do not compromise the quality or overall appearance of the item.

For out-of-season flowers, our experienced florists will substitute them with a similar flower of equal or greater value, ensuring your arrangement maintains its beauty and quality. While specific flowers may vary, the overall theme, color scheme, and aesthetic of the arrangement will be preserved.

In cases where the vase shown in the product image is unavailable, our florists/partners will select a suitable vase that matches the style and aesthetic of the arrangement while maintaining its elegance.

Delivery Attempts: Our delivery team will make reasonable attempts to contact the recipient and coordinate the delivery. If, despite these efforts, the recipient remains unreachable or declines to accept the gift, the order will be considered fulfilled.

Alternate Delivery Location: In instances of recipient unavailability, customers may be offered the option to provide an alternate delivery location within the same city. However, this is subject to the discretion of Joi Gifts, depending on the alternate address location, and is not guaranteed.

Perishable Items Consideration: For orders containing perishable items, if the recipient is unreachable on the day of delivery, and the items have been prepared, no refund or compensation will be granted.

Delivery Time Slot Selection: Customers have the option to choose a delivery time slot during the checkout process. We will make every effort to deliver your order within the selected time slot.

Specific Time Guarantee: While we strive to meet the selected delivery time slot, Joi Gifts is unable to guarantee a specific delivery time within the chosen timeslot. 

Delivery Delays: Factors such as traffic conditions, weather, and other unforeseen circumstances as well as challenges with contacting the recipient or reaching them, may impact the delivery schedule and Joi Gifts will not be held responsible or process a refund.

Exceptions and Special Cases: We understand that certain situations may warrant exceptions to our standard policy. If you believe your case is unique, please reach out to our customer care team, who will assess the situation and provide guidance accordingly.

Fixed Delivery Fees: The fixed delivery fees for your order will be presented and visible during the checkout process.

Extra Delivery Fees: For certain locations that fall outside our standard coverage areas, extra delivery fees may apply. The determination of areas considered "out of coverage" is at the discretion of Joi Gifts. Customers will be promptly notified by our team if their selected delivery location is subject to extra delivery fees post the checkout process.

Some areas are totally out of coverage for Joi Gifts. If these were selected, and the items have been prepared, Joi Gifts will not be able to deliver or cancel. The order will be considered as fulfilled on this occasion.

Secure Payment Processing: Rest assured, your payment details are handled with the utmost security. We work with trusted payment partners to safeguard your financial information.

3. ALLERGY WARNING

 

Our Products including but not limited to any and all foods, beverages, flowers, and cosmetics and any other product available on the Platforms may contain pollen or other allergens other than those identified in the product description on the specific product pages. We urge customers with known allergies to exercise caution when ordering our products. Individuals with serious allergies should refrain from ordering products which may be hazardous to their health. You hereby acknowledge and agree that you are aware that our Products may cause an allergic reaction and that under no circumstance shall we be considered liable for any allergic reaction which you or any third-party might incur following the placing of an Order of one or more of our Products.

 

4. INTELLECTUAL PROPERTY RIGHTS

If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the Services (or any portion thereof).

  • Make any unauthorized use of the Services, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email, or creating user accounts by automated means or under false pretenses.
  • Use the Services as part of any effort to compete with us or otherwise use the Services and/or the Content for any revenue-generating endeavor or commercial enterprise.

The Services does not offer users to submit or post content. We may provide you with the opportunity to create, submit, post, display, transmit, perform, publish, distribute, or broadcast content and materials to us or on the Services, including but not limited to text, writings, video, audio, photographs, graphics, comments, suggestions, or personal information or other material (collectively, "Contributions"). We reserve the right, but not the obligation, to: (1) monitor the Services for violations of these Legal Terms; (2) take appropriate legal action against anyone who, in our sole discretion, violates the law or these Legal Terms, including without limitation, reporting such user to law enforcement authorities; (3) in our sole discretion and without limitation, refuse, restrict access to, limit the availability of, or disable (to the extent technologically feasible) any of your Contributions or any portion thereof; (4) in our sole discretion and without limitation, notice, or liability, to remove from the Services or otherwise disable all files and content that are excessive in size or are in any way burdensome to our systems; and (5) otherwise manage the Services in a manner designed to protect our rights and property and to facilitate the proper functioning of the Services.

 

10. TERM AND TERMINATION

WITHOUT LIMITING ANY OTHER PROVISION OF THESE LEGAL TERMS, WE RESERVE THE RIGHT TO, IN OUR SOLE DISCRETION AND WITHOUT NOTICE OR LIABILITY, DENY ACCESS TO AND USE OF THE SERVICES (INCLUDING BLOCKING CERTAIN IP ADDRESSES), TO ANY PERSON FOR ANY REASON OR FOR NO REASON, INCLUDING WITHOUT LIMITATION FOR BREACH OF ANY REPRESENTATION, WARRANTY, OR COVENANT CONTAINED IN THESE LEGAL TERMS OR OF ANY APPLICABLE LAW OR REGULATION. WE MAY TERMINATE YOUR USE OR PARTICIPATION IN THE SERVICES OR DELETE ANY CONTENT OR INFORMATION THAT YOU POSTED AT ANY TIME, WITHOUT WARNING, IN OUR SOLE DISCRETION.

 

If we terminate or suspend your account for any reason, you are prohibited from registering and creating a new account under your name, a fake or borrowed name, or the name of any third party, even if you may be acting on behalf of the third party. In addition to terminating or suspending your account, we reserve the right to take appropriate legal action, including without limitation pursuing civil, criminal, and injunctive redress.

These Legal Terms shall be governed by and defined following the laws of the United Arab Emirates. Joi Gifts and yourself irrevocably consent that the courts of Dubai shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these Legal Terms.

There may be information on the Services that contains typographical errors, inaccuracies, or omissions, including descriptions, pricing, availability, and various other information. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information on the Services at any time, without prior notice.

The services are provided on an as-is and as-available basis. you agree that your use of the services will be at your sole risk. To the fullest extent permitted by law, we disclaim all warranties, express or implied, in connection with the services and your use thereof, including, without limitation, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. With regard to the use of the Platforms, to the maximum extent permitted by the applicable laws, Joi Gifts, its directors, officers, agents, employees, stakeholders or contractors exclude all responsibility and liability in relation to the Platforms and disclaims all warranties (express or implied) and representations (including without limitation implied warranties of merchantability and suitability for a particular purpose) regarding the use or the results of the use of the Platforms or any linked websites in terms of their correctness, accuracy, timeliness, reliability, or otherwise.

Neither Joi Gifts nor its directors, officers, agents, employees, stakeholders or contractors will be responsible for errors or misstatements or be liable, whether in contract, tort (including negligence) or otherwise, for any loss or damage howsoever caused (including direct, indirect, consequential, special losses, or loss of profits). Further, neither Joi Gifts nor its directors, officers, agents, employees, stakeholders or contractors warrant that the functions contained in the Platforms will be uninterrupted or error-free, that defects will be corrected, or that the Platforms or the server that makes it available, are free of viruses or other harmful components.

 

16. INDEMNIFICATION

 

You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of: (1) use of the Services; (2) breach of these Legal Terms; (3) any breach of your representations and warranties set forth in these Legal Terms; (4) your violation of the rights of a third party, including but not limited to intellectual property rights; or (5) any overt harmful act toward any other user of the Services with whom you connected via the Services. We will maintain certain data that you transmit to the Services for the purpose of managing the performance of the Services, as well as data relating to your use of the Services. Although we perform regular routine backups of data, you are solely responsible for all data that you transmit or that relates to any activity you have undertaken using the Services. These Legal Terms and any policies or operating rules posted by us on the Services or in respect to the Services constitute the entire agreement and understanding between you and us. Our failure to exercise or enforce any right or provision of these Legal Terms shall not operate as a waiver of such right or provision. However, it's essential to note that once an order is processed, our teams immediately begin the preparation process to ensure a swift and seamless delivery. Therefore, we have established the following Order Cancellation Policy.

Cancellation Window: Different items require different preparation times, depending on the category they fall under and the preparation time needed by our partners. The cancellation window extends until the order is processed and preparation begins.  You may request to cancel your order after checking out by contacting our customer care team. If the preparation has begun, or the items are prepared, we will not be able to cancel your order. No refund, or compensation can be provided in these circumstances.

Order Processing Time: Once an order is processed, and preparation commences by our partners in the selected country, it becomes challenging to cancel the order. The processing time may vary based on the type of items and the specific requirements of your order.

No Cancellation After Processing/Preparation: Unfortunately, we cannot entertain cancellation requests if the items have already been prepared by our partners, regardless of when the cancellation was initially requested. This is because our teams work diligently to ensure timely delivery, and once the preparation process has begun, we are unable to halt or reverse it.

Recipient Unavailability or Refusal: If, at the time of delivery, the intended recipient is either unreachable or refuses to accept the gift, Joi Gifts reserves the right to consider the order fulfilled. In such cases of recipient unavailability or refusal, no order cancellation will be accepted, and Joi Gifts will not be liable to provide a refund or compensation. This policy is applicable regardless of the reason for unavailability or refusal.

 

2. Refund, Exchange, and Return Policy

Perishable Items:Any disputes related to perishable items must be reported within 24 hours of delivery (8 hours for products containing fruits or produce), accompanied by a photo of the item. Joi Gifts will conduct a thorough investigation into reported disputes. If the item is found to be damaged, in poor condition, of low quality, or an incorrect item was sent, Joi Gifts may replace the item. Alternatively, refunds are at the discretion of Joi Gifts and are offered solely to the sender.

Non-Perishable Items: Disputes concerning non-perishable items must be reported within 7 days from receiving the order, along with a photo of the item. Joi Gifts will investigate reported disputes related to non-perishable items. If a defect is found in the item or the wrong item is dispatched, a replacement may be granted. The returned item must be first collected and must be in as-new condition, unused and fully intact in its original packaging. Alternatively, refunds may be issued at the discretion of Joi Gifts.

Refund Processing Time: Kindly be aware that all refunds will be made in the same method  used to make the payment. In countries where cash on delivery is accepted, the refund will only be made through a bank transfer.

Once a refund has been initiated by Joi Gifts, the processing time may extend up to 14 working days. The exact duration is contingent upon the policies and procedures of your issuing bank. The timeline for the refund to reflect in your account may vary based on the internal processes of your financial institution.

Baked Goods & Balloons

- All baked goods and balloons cannot be rescheduled due to their shelf life.

The order will be deemed canceled and the buyer is not eligible for a replacement or refund if:

Chocolates,nuts and prepacked edibles

-Item dispute is due to a major discrepancy in its appearance,

-The item disputed is not the item that was purchased.

-The customization on the item is missing or incorrect.

-Must be reported within 7 days of receiving the order.

-A clear photo of the item received must be shared.

 

Notes:

-A return due to a change of mind is possible, only if the item is not customized and is still in its original packaging. Return can only be approved after the item has been collected and inspected by Joi Gifts quality team.

-Chocolates,nuts, and pre-packaged edibles can be rescheduled for up to 10 days.

Joi Gifts will reach out to the recipient through the contact details provided by the buyer to collect or confirm the address. At least 3 attempts will be made within 48 hours to contact the recipient.

The order will be deemed canceled and the buyer is not eligible for a replacement or refund if:

- The address could not be confirmed by the recipient before the end of the original time slot selected.

- The recipient is not available to receive.

- The recipient refuses to receive.

Non Perishable Items

Any item that is not edible or perishable
